Who the regulation applies to
This regulation applies to:
- Operators of installations carrying out the large-scale industrial activities listed in Annex I (energy, metal smelting and processing, chemicals, waste management, etc.): around 37 000 industrial installations must obtain a permit and comply with BAT emission limit values (condition: the activity and capacity thresholds in Annex I are met)
- Operators of intensive pig or poultry farms: around 38 500 farms, covered once they meet the scale thresholds in Annex Ia (condition)
- Newly included activities: metal ore mining, battery manufacturing (gigafactories), landfills, etc. (condition)
- Member State competent authorities: responsible for permits and registration, and must carry out inspections every 1–3 years; the most serious infringements may be subject to fines of more than 3% of the EU turnover of the preceding financial year
- (Not applicable) Installations and farms below the Annex I/Ia thresholds
This Directive is an amendment to Directive 2010/75/EU (Industrial Emissions Directive) and renames it the ‘Industrial and Livestock Rearing Emissions Directive’ (IED 2.0).
The following provisions define its scope:
Article 1, point (3) — Amendments to Directive 2010/75/EU (replacing Article 2(1) 'Scope')
in Article 2, paragraph 1 is replaced by the following:
‘1. This Directive shall apply to the industrial activities giving rise to pollution referred to in Chapters II to VIa.’
Article 1, point (40) — Amendments to Directive 2010/75/EU (inserting Article 70a 'Scope' in new Chapter VIa)
This Chapter shall apply to the activities set out in Annex Ia which reach the capacity thresholds set out in that Annex.
Article 1, point (4)(b) — Amendments to Directive 2010/75/EU (replacing Article 3, point (3) 'installation')
point (3) is replaced by the following:
‘(3)
“installation” means a stationary technical unit within which one or more activities listed in Annex I, in Annex Ia or in Part 1 of Annex VII are carried out, and any other directly associated activities on the same site which have a technical connection with the activities listed in those Annexes and which could have an effect on emissions and pollution;’

What the regulation requires
| Duty | Trigger | Evidence | Timing |
Obtain an IED integrated permit and comply with BAT Operate in accordance with best available techniques (BAT/BREF) and apply an environmental management system. | Industrial activities listed in Annex I to the IED | IED permit, BAT compliance assessment, environmental management system | After transposition of 2024/1785 |
Submit a transformation plan The new IED requires high-emission installations to provide a decarbonisation transformation plan. | Energy-intensive installations subject to the IED | Decarbonisation transformation plan | After transposition of 2024/1785 |

Key provisions
Amended Article 3, point (9a) — ‘deep industrial transformation’
‘deep industrial transformation’ means the implementation by industrial operators of emerging techniques or best available techniques involving a major change in the design or technology of all or part of an installation or the replacement of an existing installation by a new installation, which allows an extremely substantial reduction of emissions of greenhouse gases in line with the objective of climate neutrality and optimises environmental co-benefits, at least to the levels that can be achieved by techniques identified in the applicable BAT conclusions, taking into account cross-media effects;
New Article 14a(1)–(2) — environmental management system
Member States shall require the operator to prepare and implement, for each installation falling within the scope of this Chapter, an environmental management system (“EMS”). ... 2. The EMS shall include at least the following: (a) environmental policy objectives for the continuous improvement of the environmental performance and safety of the installation, which shall include measures to: ... (ii) optimise resource and energy use and water reuse; ... (f) a transformation plan as referred to in Article 27d.
New Article 27d(1) — transformation plans by 30 June 2030
Member States shall require that operators by 30 June 2030 include in their EMS an indicative transformation plan covering their activities as listed in points 1, 2, 3, 4, 6.1 a, and 6.1 b of Annex I. The transformation plan shall contain information on how the operator will transform the installation during the 2030-2050 period to contribute to the emergence of a sustainable, clean, circular, resource-efficient and climate-neutral economy by 2050 ...
